The Oak Bay Police Department responded to 67 calls for service this week

2013-02 25

OB File #13-537- Theft from Motor Vehicle

Sometime overnight an unlocked vehicle was entered in the 1600 block of York Place and a Samsung cellphone was stolen.

OB File #13-563 – Theft of Motor Vehicle

Overnight in the 100 block of King George Terrace a white 1993 Suzuki Sidekick was stolen from the roadway. At the time of this report the vehicle had not been recovered.

OB File #13-588 – Theft of Property

The Oak Bay Police stopped a male in the 500 block of Beach Drive in the early hours on March 2nd.  A male was observed crouching beside a vehicle and he had the following items in his possession:

Red Kona Mountain Bicycle

A 20” DVD/Video screen complete with remote and power cord

A white bicycle seat

The male admitted that he stole the items from a nearby shed. The Oak Bay Police Department has not received a theft report regarding this incident. We are requesting the residents in the south part of Oak Bay in particular the residents in the 100-500 block of Beach Drive to contact the police if the above-noted property was stolen from your residence.

OB File #13-592 – Liquor Control Licencing Act

2145 hrs

The Oak Bay Police Department conducted radar enforcement in the 3300 block of Henderson Road.  A vehicle was observed driving at a high rate of speed southbound on Henderson Road. A traffic stop was initiated and the driver produced an “N” driver’s licence. There were two passengers in the vehicle and the police member observed an unopened full can of beer between the feet of the rear passenger. The rear passenger was17 years old and the driver and front passenger were the same age.  A search was conducted and 18 cans of beer were seized from the rear seat. The driver was issued a Violation Ticket (VT) for failing to display his “N” sign and the rear passenger was also issued a VT for possessing liquor as a minor. The officer gave the driver a verbal warning for speeding and an additional warning for having too many passengers in his vehicle. The extra passenger departed the area on foot.

 

Fail to Display “N” sign- Section 30.13 of the Motor Vehicle Act Regulation has a prescribed fine of $109.00

Minor in Possession- Section 34(3) of the Liquor Control & Licencing Act has a prescribed fine of $230.00

In addition to the radar enforcement police members also deployed a roadblock in the 800 block of Foul Bay Road. Within an hour the vehicle mentioned above with the same driver and two male passengers were stopped at the roadblock.  This time the driver had an additional five occupants (five females & 3 males) for a total of 8 passengers. The driver and the front passenger were the only two people who were wearing their seatbelts. The occupants of the vehicle immediately exited the vehicle and the driver was issued another VT for Fail to Display “N” Sign and Drive Contrary to Restriction having too many passengers. The two violation tickets issued to this “N” driver will be forwarded to the Office of Superintendent of Vehicles and there will be a substantial likelihood that the driver will receive a suspension or a prohibition from driving.

Drive Contrary to Restrictions – Section 25(15) of the Motor Vehicle Act has a prescribed fine of $109.00.

The roadblock also produced another liquor seizure from a vehicle where two mickeys of Smirnoff Vodka & Captain Morgan’s Spice Rum were seized (OB File #13-593). The passenger in the vehicle was issued another VT for Minor in Possession. Police members stopped another vehicle where another “N” driver was driving under the influence of marijuana. Pursuant to the Controlled Drugs & Substance Act the vehicle was searched and the officer seized 3 grams of dried marijuana bud. No criminal charges are being pursued. The driver was issued a 24-Hour Driving Prohibition notice (OB File #13-594) and his vehicle was towed from the scene.

OB File #13-602- Traffic Stop

A traffic stop was initiated in the 2000 block of Foul Bay Road where a vehicle was driving without its headlights on. The officer smelled a pungent smell of marijuana from inside the vehicle. The rear passenger immediately handed over 5 grams of dried marijuana bud to the officer. No charges are being pursued for this incident.
