During a Counter Attack road check a vehicle was stopped and the investigating officer noted a strong odor of liquor and slurred speech from the driver. A demand was given to the driver to provide a breath sample on a roadside screening device. The driver refused the demand contrary to the Criminal Code. Further requests were made to get the driver to provide a sample of his breath to avoid being charged with refusing to provide a breath sample. The driver continued to refuse and therefore was issued a 90 day immediate roadside prohibition and the vehicle was impounded for 30 days.
Also during the Counter Attack road check, a driver was issued a 3 day immediate roadside prohibition after he provided two samples of breath that indicated “warn”. The driver initially insisted he hadn’t been drinking.
