Weekly Media Release for Aug. 26 – Sept. 1, 2024

The Oak Bay Police Department responded to 80 calls for service this week.

Breach of Conditions

On August 27, 2024, at 4:55 am, the Oak Bay Police received a call advising that an unknown male had uttered threats to the complainant in the 2000 block of Oak Bay Ave. Police attended the area and located the 47-years-old male suspect. The suspect was arrested for Uttering Threats. Police searched the suspect and located a knife; the suspect was on conditions from a Court Release Order to not possess any knives. Police also located a female’s identification on the suspect which had been stolen in April in a Victoria Police file. The suspect, Daniel Poisson was held for a bail hearing charged with Breach of a Release Order S. 145(5)(a) CC, Possession of Property Obtained by Crime S. 355(b) CC and Uttering Threats S. 264.1(1)(a) CC. Poisson was remanded in custody and will be appearing in court on September 10, 2024. (OB File 24-2295)

Assault

On August 29, 2024, the Oak Bay Police received a report of an assault in the 1000 block of Beach Dr. The complainant was trimming hedges when a female, who was unknown to the complainant became irate. The female slapped the complainant in the cheek. The female departed the area in a vehicle. A short time later, police received a call that the female suspect was back in the area. Police attended and arrested the 49-year-old female for assault. The female was released on an Undertaking to appear in court at a later date. (OB File 24-2325)

Collision

On August 29, 2024, at 8:51 am, the Oak Bay Police responded to a collision involving a vehicle and a cyclist at the intersection of Foul Bay Rd and Byron St. Police determined that the vehicle was passing the cyclist and failed to leave enough room and struck the cyclist. The cyclist suffered injuries (cracked rib) and was transported to the hospital. The 70-year-old female driver of the vehicle was issued a Violation Ticket for Fail to Pass at a Safe Distance S. 157(1)(a) MVA $109. (OB File 24-2326)


Immediate Driving Prohibition

On August 29, 2024, at 7:44pm, the Oak Bay Police were conducting a Counterattack Road Check on Beach Dr near Cattlepoint. A vehicle travelling Southbound attempted to turn around and was stopped by police. The 74-year-old man displayed symptoms consistent with having consumed alcohol and subsequently provided a breath sample in an Approved Screening Device. The reading was a Warn, which indicated that the male’s blood alcohol level was between 60 – 99 milligrams of alcohol in 100 milliliters of blood. The man was issued a 3-day Immediate Driving Prohibition, and his vehicle was impounded for 3 days. (OB File 24-2333)

24-Hour Driving Prohibition

On August 30, 2024, at 8:51 pm, the Oak Bay Police were conducting a Counterattack Road Check in the 1700 block of Oak Bay Ave. A vehicle drove up and the 47-year-old male driver had a smell of alcoholic beverage on their breath. The driver provided a breath sample in an Approved Screening Device and the subsequent reading was 52 milligrams of alcohol in 100 millilitres of blood. The police formed the opinion that the male’s ability to operate a motor vehicle was affected by alcohol. The male was issued a 24-hour driving prohibition S. 215 MVA. (OB File 24-2343)
